Proposed Decision: Riverside County Unlawfully Declared Impasse

An administrative law judge (ALJ) with the Public Employment Relations Board (PERB) has issued a decision finding that the County of Riverside unlawfully declared impasse during negotiations for a successor MOU in 2009. After unlawfully declaring impasse, the County refused to implement merit step increases for approximately thirty days. The ALJ found that the County prematurely declared impasse, that the County could not create a self-imposed deadline when bargaining had to end, and ordered the County to make whole those employees whose merit step increases had been denied as a result of the unlawfully implemented last, best, and final offer. The County has filed exceptions with PERB, which are pending.
