David Rosenfeld is a named shareholder of the law firm. Mr. Rosenfeld has been practicing union-side labor law since his graduation from University of California, Berkeley School of Law in 1973.
Mr. Rosenfeld has argued approximately 250 cases before federal and state courts of appeal, including ground-breaking cases before the United States Supreme Court, the California Supreme Court, and the National Labor Relations Board. In particular, he was chief labor counsel in Morillion v. Royal Packing Co. (2000) 22 Cal.4th 575 (requiring employers to pay employees for all hours in which they are subject to the employer’s control, including work-related travel time) and Cicairos v. Summit Logistics, Inc. (2005) 133 Cal.App.4th 949 (holding that employers have an affirmative obligation to ensure that workers are actually relieved of duty during breaks). These cases established important legal precedents and broadened rights for unions and working people.
Mr. Rosenfeld takes pride in developing creative and unusual tactics for unions and workers and is a prolific author and presenter on such strategies. His book “Offensive Bargaining” has been widely circulated and he has presented on bargaining strategies to unions across the country and beyond. Those strategies have been adopted and successfully used as effective weapons against anti-union employers by labor unions throughout the country.
Mr. Rosenfeld is one of the authors of “California Workers’ Rights,” published by the Institute for Research on Labor and Employment at UC Berkeley. This is a leading resource for union activists on using the law in the workplace. He also one of the authors of “Hey, the Boss Called Just Called Me Into the Office,” also published by the UC Berkeley Institute for Research on Labor and Employment, which explains Weingarten rights. Additionally, Mr. Rosenfeld is a contributor to “The Campaign Guide: Organizing and Contract Enforcement in the Construction Industry,” published by the North America’s Building Trades Unions. This treatise serves as the leading resource on this subject for construction industry unions nationwide. He is also an author of practitioner comments to the leading treatise on Labor Law: “Labor Law Analysis and Advocacy” by Professors Gorman and Finkin.
One of the things Mr. Rosenfeld likes most about being a union lawyer is that the role provides him with the opportunity to help union staff and member leaders be more offensive, aggressive and effective in dealing with employers.
Mr. Rosenfeld taught labor law courses at the UC Berkeley School of Law for many years. These include the school’s foundational labor law course, a course he designed entitled “Representing Low Wage Workers,” and various seminars. He is also the recipient of awards from local Labor Councils and the California Labor Federation.
Mr. Rosenfeld is licensed to practice law in California and is admitted to several federal district courts and courts of appeals, including the United States Supreme Court.
