AB1606 Unlikely To Affect Public Sector Impasse Procedures

The California legislation AB1606, signed into law by Governor Brown on Sept. 14, provides timeframes for unions to request fact-finding under the Meyers-Milias-Brown Act when bargaining parties fail to reach agreement on a collective bargaining agreement. However, this law is unlikely to affect impasse procedures in public sector bargaining, since it mirrors regulations that have already been enacted by the Public Employment Relations Board. The law also specifies that the procedural right of a union to request a fact finding panel cannot be expressly or voluntarily waived.
