SB 949 Superior Courts to Provide Court Users Access and Time to Use Lactation Rooms

SB 949 expands access to lactation rooms at superior courts in California.

Current law requires superior courts, as employers, to provide employees with the use of a lactation room or other location to express milk in private, along with a reasonable amount of break time to accommodate an employee needing to express milk.

Beginning July 1, 2026, superior courts will need to provide any court user access to a lactation room in any courthouse in which a lactation room is also provided to employees.

Also beginning on July 1, 2026, superior courts will need to provide any court user who is participating in an ongoing court proceeding with a reasonable amount of break time during a court proceeding to allow the court user to express breast milk for the user’s infant child.

This change will improve access to superior courts for lactating individuals.
